Terms of Use

1. INTRODUCTION

The use of the Advanced Scientific Research Projects platform and the services offered on it (hereinafter collectively referred to as the “Services”, except for services provided under a separate written agreement and/or separate offer) is governed by the terms of this agreement (hereinafter referred to as the “Terms” or the “Agreement”). This Agreement constitutes a public offer intended for an unlimited number of persons. For services provided via the Internet, the company “ASRP” refers to Advanced Scientific Research Projects, duly registered in accordance with the legislation of the Republic of Kazakhstan. The service provider may be ASRP or any other legal entity and/or individual entrepreneur authorized by the Administration to place information about goods and/or services on this website. The website administration is ASRP (hereinafter referred to as “we” or “us”). Please review these Terms periodically to stay informed of any updates. Your use of the Services signifies your acceptance of these Terms and all amendments thereto. If you do not agree with these Terms, do not use the Arcanum12th platform.

2. ACCEPTANCE OF TERMS, USE OF THE PLATFORM, AND ORDERING SERVICES

In order to use the Services, you must accept (agree to) the Terms.

Until the Terms are accepted, the use of ASRP Services is prohibited.

Acceptance means full and unconditional acceptance of the Offer by performing one of the following actions: (A) performing an action indicating acceptance of the Terms (clicking a button or checking a corresponding checkbox) on the service order page on the website; or (B) actual use of the Services. In this case, you agree that we consider the use of the Services as acceptance of the Terms.

(C) In the case of purchasing a prepaid service package, you enter into an Agreement with us at the moment you click the “Participate” or “Buy” button (or a similar option) and enter your payment details in the payment system interface.

Please note that by using the ASRP platform (free content, paid content, and paid subscriptions), you accept the Rules of Conduct on the ASRP platform asrp.tech/terms/offer and the Privacy Policy asrp.tech/terms/privacy-policy.

Please review the above documents before using the ASRP platform. If you do not agree with them, immediately leave the platform and discontinue its use.

You agree not to engage in any activity that interferes with or disrupts the operation of the platform, services, or related servers and networks. If you have registered on the platform, placed an order for services, or use our services, we may send you notifications, promotional messages, informational communications, and other materials.

Moment of contract conclusion.

By visiting the ASRP platform and using free materials and services available in open sections, you enter into a license agreement with us for the use of content. By registering for a free webinar or subscribing to a free email newsletter, you enter into a service agreement with us. In this case, the Agreement includes these Terms of Service. In the case of purchasing a prepaid service package, you enter into an Agreement at the moment you click the “Participate” or “Buy” button (or a similar option) and enter payment details into the payment system interface. In this case, the Agreement includes these Terms of Service. If payment is made by another method, the Agreement is considered concluded at the moment the issued invoice is paid. You may purchase multiple products or additional services simultaneously and use one or more services by making a one-time payment for the selected service package.

Correction of input errors.

By registering on our website or ordering services, you may interrupt the purchase process at any time and correct any input errors before completing registration or placing an order.

Conclusion of the transaction.

The procedure for forming and concluding the relevant agreement (contract) depends on the selected product (service package) and payment method. Registration on the platform, subscription to the platform, subscription to email newsletters, placing orders, and payment for Services on the platform (entering your payment details) are not possible without your consent to these Terms, the ASRP Platform Rules of Conduct, and the Privacy Policy.

3. SUBJECT OF THE AGREEMENT

The subject of this agreement is the use of the ASRP platform and the services we offer on it. Terms of use for paid services and materials of the ASRP platform. Users may be individuals who have reached the age of majority, are legally competent, and have accepted these Terms, the rules of conduct on the ASRP platform, and the Privacy Policy. Only the persons in whose name the service order is placed have the right to use the purchased services. Additional terms and conditions. As we provide many different services, some of them may have Additional Terms of Use. Such terms may be provided in the relevant sections of the platform, on service order pages, or in legal notices sent to you.

We reserve the right to introduce additional terms of use for the site and services that are mandatory for compliance.

4. DESCRIPTION AND COST OF ASRP SERVICES

Description of services: The scope of services available to you depends on the terms of purchase of the product, service, subscription, or service package.

ASRP Holding provides the following services:

1) Providing access to paid content on the Arcanum12th platform in the form of a subscription for a specified period.

Subscription registration.

When subscribing to services, you independently choose the Tariff Plan and the subscription period based on the current ASRP offer published on the platform or on separate ASRP landing pages. The subscription is considered registered after you confirm your agreement with the Terms and successfully enter your payment details.

If you subscribe to a renewable service, funds are debited from the linked card for the minimum subscription period at the time of registration. In the case of automatic renewal of the service subscription for a new period, funds are debited in advance before the start of services in the new billing period. Payment method, linking a bank card.

The subscription must be paid with a bank card convenient for you, using the payment system on the website. The bank card is considered linked to your account after sending payment details or after linking the card in the user account. By using the bank card to register or pay for the subscription, you confirm that you have the right to manage the funds on the card and are responsible for providing ASRP with false information about the cardholder or unauthorized use of another person's bank card. After the first payment or linking the card in the account, funds are debited automatically and do not require additional consent (action) from you. By sending payment data, you grant us the right to debit funds from your bank card under the stated Terms. You have the right to cancel the subscription at any time in the prescribed manner. To do this, contact our support service or adjust settings in your account.

Subscription cost and payment procedure on the Arcanum12th platform

We publish the Terms of Subscription Tariff Plans (subscription period and cost) on the Arcanum12th platform. The payment amount always includes the payment system commission for processing the payment; at the same time, the subscription cost is the difference between the payment you made and the commission deducted by the payment system and banks.

You make the first payment by sending your payment details through the payment system frame (special form), after which your bank card is considered linked to the user account. All subsequent payments are debited automatically from the linked bank card according to the selected Tariff Plan. After registering the subscription, funds are debited from the bank card for the minimum subscription period, according to the selected Tariff Plan. In the case of automatic renewal of the subscription for a new period, funds are debited on the first day of the new period.

The user can purchase a subscription under an ASRP promotional offer if one is active at the time of subscription registration. The promotional offer is valid only for the period set by ASRP and under the conditions established by ASRP. ASRP does not notify the User about the expiration of the promotion; in turn, the User is obliged to independently track the expiration dates on our platform. After the established ASRP promotion period ends, the cost for the next subscription period on the Arcanum12th platform is automatically debited according to the unified tariff in effect at the time of debit.

In case of purchase.

A subscription purchased by the user under a promotional offer is non-refundable.

Failure to fulfill payment obligations.

If it is impossible to debit funds from your payment card or the payment is declined due to your fault (for example: insufficient funds on the card; allowed credit limit already exhausted), access to the service is blocked. We provide you with an additional period to make the payment up to a month (30 days) to preserve all accumulated content.

If we pay additional commissions or incur other expenses due to payment rejection caused by your fault, we reserve the right to additionally debit your card/account for the actual expenses incurred.

Subscription Tariff Plans:

Monthly plan (prepayment, paid monthly)

Access to services is provided immediately after processing the initial payment. You gain access to the Arcanum12th service and materials for a month (from the day of subscription registration to the same day of the following month inclusive). If the next month does not contain the specified day, the last day is considered the nearest calendar day of that month. If you do not cancel the subscription before the end of the paid period, the subscription is automatically renewed for the next month under the Monthly Tariff Plan. The subscription cost indicated at the time of subscription registration is charged each month until you cancel the subscription. Since there is no long-term agreement in this case, this amount may change starting from the next subscription month. Long-term agreement (for twelve months subscription), prepayment: Access to the platform is provided immediately after processing the initial payment. You are charged a one-time amount for the selected subscription period (twelve months), according to the current offer published on the Arcanum12th platform at the time of purchase. If you do not cancel the subscription before the end of the paid period, the subscription is automatically renewed—the agreement will be extended for the same period upon the subscription renewal date (end date of the paid subscription period). The cost of the paid subscription period does not change, regardless of the current offer. The cost of subscription renewal in the next period may change.

Lifetime or Eternal plan (one-time payment)

Access to the Arcanum12th platform is provided immediately after processing payment for the Lifetime plan.

You receive indefinite access to all Arcanum12th platform materials without restrictions starting from the subscription registration day.

Under the Lifetime plan, ASRP and users understand the indefinite period of using the Arcanum12th platform, which may be limited solely by the existence of the Arcanum12th platform itself, as well as the operational period of ASRP Holding, namely its: liquidation, reorganization, or cessation of activity. The right to use a Lifetime subscription is not inheritable.

After registering the subscription and processing the initial payment for this Tariff Plan, and providing you access to the Arcanum12th platform, the paid subscription amount is non-refundable as the service is considered duly provided in full.

2) Providing access to free content on the Arcanum12th platform

If you use services or materials available in the open sections of the Arcanum12th platform, ASRP Holding, and distributed for free, you receive only basic information on the topic of interest.

When purchasing a paid service package, subscription, or course, you receive extended information.

3) Information services in the form of access to online courses

When purchasing an online course on the Arcanum12th platform at the moment of order (entering payment details into the payment system frame), a one-time debit of the ordered service cost occurs, and the payment card is linked to your account.

Failure to fulfill payment obligations.

We reserve the right to make claims regarding violation of established payment deadlines. If it is impossible to debit funds from your payment card, we have the right not to start or to suspend services until they are paid.

Service provision terms.

The client may use the paid online course no later than within 3 months from the payment date.

If the client did not use the purchased online course within 3 months from the purchase date, the funds for the purchased course are non-refundable.

Access time to services when purchasing separate tariffs and service packages may differ from the above periods; information on access periods will be indicated on the service payment page. Carefully review all conditions before paying for the service.

ASRP Holding has the right to set discounts on online courses, to receive them the User must:

1. Make a prepayment in the amount specified and published by us on the product/service page on the Arcanum12th platform and/or on product pages, on other websites, services, and social networks of ASRP Holding

2. The remaining part of the online course cost must be paid by the user within 72 hours from the moment of prepayment. In case the user made a prepayment for the online course, ASRP Holding reserves a place for the user at the next online course start. If the user does not pay the remaining part of the online course cost within 72 hours from the prepayment, the ASRP Holding prepayment is non-refundable under any circumstances. If the user made a prepayment and did not pay the remaining part of the online course within 72 hours, the user has the right to pay the remaining part (non-promotional) before the next course start. If the user did not pay the remaining part within 72 hours from the prepayment and before the course start, the prepayment is non-refundable. If the user, for any reason, did not pay the remaining cost, they have the right to purchase another ASRP online product equivalent in value to the already paid prepayment, valid at the time of user request. To purchase an online product/service equivalent to the paid prepayment, contact us at community@arcanum12th.education or by phone to support within the specified period.

To purchase an online product/service equivalent to the paid prepayment, be sure to provide: full name, tax ID, e-mail, service name (course, service package), product for which prepayment was made, prepayment date, and other necessary information. If the user pays the remaining part of the online course (non-promotional) after the nearest course start for which prepayment was made, the user has the right to join that course stream that has already started.

4) Individual informational consultations with Arcanum12th experts

When purchasing an expert consultation on the Arcanum12th platform at the moment of order (entering payment details into the payment system frame), a one-time debit of the service cost occurs.

Failure to fulfill payment obligations.

We reserve the right to make claims regarding violation of established payment deadlines. If it is impossible to debit funds from your payment card, we have the right not to start or suspend services until they are paid.

Service provision terms.

The client may use the paid consultation no later than within 3 months from the payment date.

The client can cancel or reschedule the consultation date and time no later than one day before the booked date. If canceled less than a day before, the client must contact support to reschedule as soon as possible.

If the client paid for the consultation and, for reasons beyond ASRP's control, did not contact the expert at the scheduled time without prior notice, the consultation is considered properly performed in the agreed scope and time, and the payment is non-refundable.

ASRP Holding does not hire or employ Experts and the Company is not responsible for interactions between Experts and clients. ASRP Holding is not responsible for disputes, claims, losses, injuries, or damages of any kind arising from or related to the actions of Experts.

5. ADDITIONAL PAID CONTENT AND SERVICES

Releases of the Arcanum12th platform, provided under subscription terms, may contain links to additional paid content and services that you can purchase separately at your discretion.

Additionally, you may purchase individual units of Arcanum12th platform content for any month and year for an additional fee, provided that they are available for sale. We publish the current offer of additional paid content and services on the Arcanum12th platform or on additional landing pages.

Please note that some prepaid service packages include access to multiple training courses at once. However, if this is not the case, to obtain informational materials for additional training programs, you must purchase such Services separately.

Some training programs involve independent work and completion of certain tasks (homework), which are part of the service delivery process.

Cost of services.

The cost of the services you purchase (service packages within the training program, course, subscription) is published by us on the product or service page, on the Arcanum12th platform, and/or on product pages on other websites, services, and social networks of the ASRP Holding.

6. USER ACCOUNT

Registration process

For convenience in using the services of the ASRP community, after placing your first order for Services, you receive a user account on the educational platform Arcanum12th, as well as access to your personal dashboard to receive services. One user account is sufficient to access the services of the ASRP holding.

7. PAYMENT METHODS

You can review the available payment methods for our services on the Arcanum12th platform. In the case of payment for services via bank transfer, you are required to notify us of the completed payment and send images of documents confirming the payment to the email address provided on the website. To receive timely access to services, notify us of the payment in advance. We reserve the right, at any time, at our discretion, to change the payment method of the purchased product and/or refuse the previously offered payment method, offering alternative payment methods instead.

The Company has the right to provide one or several payment method options. The Company has the right at any time and at its discretion to modify or remove any payment methods on the Arcanum12th platform without any obligation to notify or amend these Terms. REFUND AND POSTPONEMENT POLICY FOR SERVICES

After placing an order and paying for Services, in each individual case, you have the right to refuse the Services and receive a refund. You have the right to refuse the paid services by notifying us in advance, within the established deadlines and in the manner provided by these Terms.

Online service cancellation policy:

For online courses, the following procedure applies: You have the right to refuse online services (access to recordings of trainings, webinars, courses, and other content) before the course start date and before access to the recordings is provided. - If you refuse online services before the course start date and before access to recordings, the full paid amount will be refunded, except for any additional payment system commission related to the refund. - If you refuse online services on the course start date and access to recordings is provided, the service is considered rendered and the paid amount is non-refundable. The start date of the Services under these Terms is considered the course start date and the date of access to recordings of trainings, webinars, and other content.

Service period.

The client may use the paid online course no later than 3 months from the date of payment.

If the client does not use the purchased online course within 3 months from the date of purchase, the funds for the purchased course are non-refundable.

Procedure for service cancellation

To cancel services and request a refund, write to us at community@arcanum12th.education within the established deadlines. To process the refund, you must provide: full name, taxpayer ID, and email used when placing the order; the name of the Service (course, service package); order date; payment information; reasons for cancellation, submit a written request and send a scanned copy, as well as provide any other necessary information. You understand that if you do not provide the required information, we have the right to refuse the refund and not process your request. We reserve the right to terminate the agreement without reason, provided that we send you written notice at least two (2) weeks before the planned termination date. Consequences of service cancellation: If you request a refund within the established deadlines, we commit to refund all payments received for the Services (service package, booked participation) within fourteen (14) days of receiving the request. The refund will be made using the same payment method used for the service payment. We will also deduct from the refund any additional payment system fees related to the refund. If you did not use the services (did not attend the event, masterclass, or training, did not use online services, did not complete the online course) not due to our fault, or refused further use of services and online courses in violation of the specified deadlines and procedure, the cost of paid but unused services is non-refundable.

Special cancellation conditions.

We reserve the right to set different cancellation rules for individual Services (courses, products, marathons, broadcasts, masterclasses, webinars, intensives, etc.), publishing specific cancellation conditions on the product page. Postponement of service period: No later than two (2) months from the payment date, you may request to postpone the service period to one of the two nearest calendar start dates of the corresponding course and participate in one of the next two course sessions (provided an equivalent participation package is available), and we will inform you of the nearest start dates. Service period postponement can occur no more than once. If you request postponement outside the deadlines or procedures specified in this offer, you lose the right to postpone and the right to a refund. To request a service postponement, notify us within the established deadlines as follows: write to community@sexeducation.com.ua within the deadlines. To process the postponement, provide full name, taxpayer ID, email, service name, order date, payment info, reasons for postponement, and other necessary details. We reserve the right to set different postponement rules for individual services or products, amending this offer.

If at the time of the postponement request, the course cost has changed or ASRP has ceased providing the course, the user/client has the right to take another course or purchase a service package equivalent to the previously paid amount.

Arcanum12th subscription cancellation policy

To cancel your Arcanum12th subscription, go to 'Profile', then 'Purchases'. In the top right of the widget showing your subscription, click the three-dot symbol to open additional settings and click 'Cancel Subscription'. On the page that opens, click 'Cancel Subscription' and then 'Continue Cancellation' until a message confirms your subscription has been canceled.

If canceled during the trial period, no additional charge will be made to your card, and access to the service and all Arcanum12th materials for the month will remain until the end of the trial period. The paid amount for the trial period is non-refundable.

If you decide to cancel the subscription, the charged amount will not be refunded, and the service will continue until the last paid day of the month in which the cancellation was made (inclusive).

The user is entitled to a refund only in case of lack of access to the paid subscription for 6 days due to technical issues caused by Arcanum12th. Refund requests must follow the deadlines and procedures set out in these Terms.

Cancellation policy for individual expert consultations on Arcanum12th

The user may cancel or reschedule the consultation no later than one day before the booked date.

If the user cancels the scheduled consultation less than one day before the booked date, they must contact support to reschedule to the next available date and time as soon as possible. If the client does not contact support before the consultation date, the consultation is considered properly rendered and payment is non-refundable.

To request a consultation reschedule, write to community@arcanum12th.education within the established deadlines. Provide full name, taxpayer ID, email, consultation name, order date, payment info, reason for rescheduling, and other necessary information.

If the client paid for the consultation and, due to reasons beyond the Company’s control, did not attend at the scheduled time without notifying the expert more than a day in advance, the consultation is considered rendered, and payment is non-refundable.

Expiration of cancellation period

If services are refused outside the cancellation deadlines or procedure, no refund is provided, and such refusal is considered a breach of these Terms.

We may cancel the agreement with you at any time if: (A) you breach any Term (or act in a way indicating unwillingness or inability to comply), or (B) required by law (e.g., service provision is illegal), or (C) Arcanum12th ceases providing services in your country, or (D) you breach the Terms or owe payment for services. (E) If you fail to comply with platform rules, we may deny access and terminate the agreement unilaterally. If you attempt to interfere with the platform or severely violate the Terms, we may suspend or block your access completely.

The Company reserves the right to cancel a user's course participation or subscription unilaterally, without obligation to refund payment if the user violates Arcanum12th platform rules.

8. REFUND AND SERVICE DATE POSTPONEMENT POLICY

After placing an order and paying for Services, in each individual case, you have the right to refuse to receive the Services and obtain a refund. You have the right to refuse the paid Services by notifying us in advance, within the established deadlines and in accordance with these Terms.

Policy on refusal of online services:

For online courses, the following procedure applies: You have the right to refuse online services (access to training recordings, webinars, courses, and other content) before the course start date and before access is granted. - If you refuse online services before the course starts and before access is provided, the full amount paid will be refunded, except for any additional payment system fees associated with the refund. - If you refuse online services on the course start date or after access is provided, the service is considered rendered and the paid amount is non-refundable.

The service start date under these Terms is considered the course start date and the date access is provided to training recordings, webinars, and other content.

Service deadlines

The client may use the paid online course no later than 3 months from the date of payment. If the client did not use the purchased online course within 3 months from the date of purchase, the payment for the purchased course is non-refundable.

Service refusal procedure.

To refuse services and request a refund, write to us at community@arcanum12th.education within the established deadlines. For a refund, please provide: full name, tax ID and email used when placing the order; the service name (course or service package); order date; payment information; reason for refusal; a written request with a scanned copy; and any other necessary information. If you fail to provide the necessary information, we reserve the right to refuse the refund and not process your request. We reserve the right to terminate the agreement without specifying reasons, provided you are notified in writing at least two (2) weeks before the planned termination date. Consequences of service refusal: If you submit a refund request within the established deadlines, we undertake to return all payments received for the Services (service package, booking) within fourteen (14) days of receiving the request. The refund will be made using the same payment method used. Additional payment system fees related to the refund will be deducted. If you did not use the services (did not participate in events, masterclasses, training, online services, or online courses) through no fault of ours or violated the deadlines and procedure for using online services, the cost of paid but unused services is non-refundable.

Special refusal conditions.

We reserve the right to set different refusal rules for specific Services (courses, products, marathons, live sessions, masterclasses, webinars, intensives, etc.) by publishing special refusal conditions on the product page.

Service date postponement.

No later than two (2) months from the payment date, you may request to postpone the service date to one of the two nearest course start dates and participate in one of the two following course flows (subject to availability of an equivalent package). Postponement can only be requested once. If you request a postponement outside the terms or procedure of this offer, you lose the right to postpone and refund.

To request a service date postponement, notify us within the established deadlines at community@arcanum12th.education. For the postponement request, provide: full name, tax ID and email used when placing the order; service name (course or package); order date; payment information; reason for postponement; and any other necessary information. We reserve the right to set different postponement rules for specific services and/or products.

If at the time of the request the course price changed or ASRP Holding stopped providing this course, the user/client has the right to take another course or purchase a service package equivalent to the previously paid amount.

Arcanum12th platform subscription cancellation policy.

To cancel a subscription on Arcanum12th, go to 'Profile' > 'Purchases'. Click the three-dot icon on your subscription widget and select 'Cancel Subscription'. On the next page, click 'Cancel Subscription' after viewing the screen until the message confirms your subscription is canceled.

During the trial period, no additional charge will be applied, and access to the service and all Arcanum12th materials for the month will be provided until the trial period ends. Amounts paid for the trial period are non-refundable.

If you decide to cancel the subscription, the debited amount will not be refunded and the service will continue until the last paid day of the month in which the cancellation occurred.

The user is entitled to a refund only if access to the paid subscription is unavailable for 6 days due to technical issues caused by Arcanum12th. Refund requests are made in accordance with these Terms.

Policy for refusal of individual expert consultations on Arcanum12th.

The user may cancel or reschedule the consultation at least one day before the booked consultation date.

If the user cancels less than one day before, they must contact support to reschedule to the next available date and time. If the client does not contact support, the consultation is considered provided, and the payment is non-refundable.

To request a consultation date change, write to community@arcanum12th.education within the deadlines and provide: full name, tax ID, email, consultation name, order date, payment information, reason for rescheduling, and other necessary information.

If the client paid but, due to reasons beyond the Company's control, did not contact the expert in time, the consultation is considered properly executed, and the payment is non-refundable.

End of refusal period.

If services are refused outside the deadlines or procedure, refunds will not be issued, and such refusal is considered a violation of these Terms.

We may terminate the agreement at any time if: (A) you violate any Terms (or act in a way showing inability or unwillingness to comply), (B) required by law, (C) Arcanum12th ceases services in your country, (D) you violate Terms or have unpaid service fees, or (E) you fail to follow platform rules or attempt to interfere with the platform. In such cases, access may be suspended or blocked.

The Company reserves the right to cancel the User's course participation or subscription unilaterally, without refund, if the User violates the platform rules.

9. RIGHT TO USE Arcanum12th PLATFORM CONTENT

Depending on the services ordered, you gain access to certain content (informational and educational materials), the copyrights and related rights of which are protected or in any case belong to us, regardless of registration and territorial scope. We grant you a non-exclusive, non-transferable right (limited license) to use the content for non-commercial purposes under the terms of this agreement for the entire service period / paid subscription period, unless otherwise specified in the participation package terms. You are warned that photographing, audio or video recording of the learning process (seminars, workshops, webinars, live streams, online courses, lesson recordings, consultations) is strictly prohibited. Violation of this requirement will result in denial of access to services. Use of intellectual property: All rights to the Arcanum12th platform, including its components: design, structure, software and computer databases, content, and content management system, belong to Arcanum12th INC. All materials posted on the Arcanum12th platform, as well as materials provided to the user during paid services (content), are subject to copyright, the use of which belongs to ASRP Holding.

Any software available for download on the Arcanum12th platform is the intellectual property of the Company and/or its partners. The Company grants the User the right to use the software exclusively for the User’s personal non-commercial use, with the usage fee included in the subscription cost or the cost of services offered on the Arcanum12th platform.

All rights to the software, including copyright and other exclusive rights, remain with the Company and/or the software manufacturer. Copying, using (reproducing), or distributing materials posted on the Arcanum12th platform or provided to the user during paid services, as well as using content for competitive purposes, without written permission from the rights holder, is strictly prohibited and punishable by law.

You agree not to reproduce, duplicate, copy, sell, exchange, or resell the Services for any purpose unless such rights were granted to you by Arcanum12th INC in a separate written agreement. Any violation of copyrights and related rights is subject to the laws of the country providing the services and international law and may entail civil, administrative, and criminal liability.
